01 Acceptance of Terms

Welcome to XKRISK. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and XKRISK (“we,” “us,” or “our”) regarding your access to and use of xkrisk.com, including all associated web interfaces, documentation, sample datasets, and communication channels (collectively, the “Platform”).

By accessing, browsing, or utilizing the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

02 Permitted Use & User Conduct

The Platform is provided for informational, evaluation, and authorized institutional engagement purposes. You agree to use the Platform only for lawful purposes and in accordance with the following standards:

• Authorized Evaluation: You may review publicly presented dataset schemas, interactive code samples, and delivery specifications for prospective commercial evaluation.
• Prohibited Conduct: You agree not to:
  1. Engage in automated scraping, harvesting, or systematic extraction of data outside of authorized, authenticated API or SFTP channels.
  2. Attempt to probe, scan, or test the vulnerability of our servers, network firewalls, or authentication gateways.
  3. Introduce malicious code, denial-of-service vectors, or automated bots designed to disrupt platform availability.
  4. Impersonate any institutional entity or misrepresent your corporate affiliation when requesting data feeds or samples.

03 Intellectual Property & Proprietary Rights

All materials available on or through the Platform—including but not limited to the XKRISK name, logos, visual layouts, website designs, normalized credit data schemas, Model Context Protocol (MCP) server implementations, sample JSON taxonomies, and documentation—are the exclusive intellectual property of XKRISK or its licensors and are protected under copyright, trademark, and trade secret laws.

Nothing in these Terms grants you any right, title, or interest in or to our trademarks, service marks, logos, or proprietary data taxonomies without our prior written consent.

04 Commercial Data Licenses & Master Service Agreements

These website Terms govern general browsing and evaluation of the Platform.

Access to full commercial data feeds (including production CDS curves, normalized historical 10-K/10-Q financial datasets, real-time SEC 8-K alerts, ABS performance feeds, high-throughput REST endpoints, and institutional SFTP directories) is governed exclusively by separate, definitive written agreements:

• Master Data License Agreement (MDLA): Defines the scope of data usage, redistribution permissions, internal research rights, and pricing.
• Institutional Service Level Agreement (SLA): Governs feed delivery schedules, uptime guarantees, PGP verification, and dedicated support commitments.

In the event of any conflict between these general Terms and an active executed Master Data License Agreement, the executed agreement shall supersede and govern.

05 Financial Research Disclaimer

Users and subscribers are solely responsible for conducting their own independent credit, risk, and financial assessments. XKRISK does not endorse, recommend, or sponsor any security, derivative, issuer, or trading strategy.

06 Platform Availability & Disclaimers

The public website, sample feeds, and interactive code playgrounds are provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by applicable law, XKRISK disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the website will operate without interruption or error.

07 Limitation of Liability

To the fullest extent permissible by applicable law, in no event shall XKRISK, its affiliates, directors, employees, or partners be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, goodwill, or business interruption) arising out of or in connection with your use or inability to use this website or its informational content.

08 Governing Law & Inquiries

These Terms shall be governed by and construed in accordance with standard commercial legal principles, without giving effect to any principles of conflicts of law.

We reserve the right to revise or update these Terms from time to time. The “Last Updated” date at the top of this page indicates the effective date of the current version. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
